Argentina's Immigration System

Argentina's Dirección Nacional de Migraciones (National Immigration Directorate) has digitized its processes. There are two separate portals, and each comes with its own surprises.

The problem is that most people do not know which agency handles what, and the consequences of being in the wrong process for months or years are real. Lost time. Money spent on documents that turn out to be unnecessary. And, maybe worse than any of that, a growing sense that the system does not have a place for you.

We work with a lot of people who do not need a visa to enter Argentina as tourists. For them, the standard path to residency is straightforward on paper: enter the country, apply for residency from within, receive a precaria permit, and wait. But that process requires staying in Argentina for the duration. And that is where things get complicated.

Decree 366/2025, the Immigration Reform of May 29, 2025, introduced some stricter language around the precaria and left it to the discretion of the Immigration Department whether to grant it at all. In practice, however, it is always issued. Without it, the applicant would simply be undocumented while waiting, which serves nobody.

Recently, Argentina’s reputation as a destination for investment, lifestyle, and opportunities has been growing. However, another asset is increasingly attracting international attention: the Argentine passport.

In our daily practice, we see the same situation over and over: people who want to spend three, four, maybe six months a year in Argentina, without knowing exactly how many, and without wanting to take on the physical presence requirements that come with residency.

Argentine immigration law is full of interesting gaps between the two, and the rentista residency might be the best example we have. Argentina's passive income residency, the rentista, is one of the most misunderstood categories in our immigration system. And honestly? It's not your fault if you got confused.
